Former Deming teacher sentenced for unlawful transaction with a minor

MOUNT OLIVET -- Sentencing in the case of former Deming teacher Crystal Wells, 33, was paused as it began, while Circuit Court Judge Robert McGinnis allowed Wells and her attorney time to read typed victim impact statements from her victim and the victim's mother.

In January, Wells was arraigned on six counts of rape for her relationship with a teen male student, while off school grounds.

On March 3, Wells pleaded guilty to a reduced charge of six counts of unlawful transaction with a minor, effectively avoiding being required to register as a sex offender, but required to attend sex offender counseling, relinquish her Kentucky licence to teach and face sentencing of up to five years for each charge.

Monday, Well's attorney elaborated on her counseling sessions and included comments Wells was being treated for depression; she had resigned from her job, her marriage was falling apart and a divorce was pending which would be affecting her two young daughters.

"She is learning to deal with what she has done," said John Dutra, her attorney.

He pleaded for a probationary sentence, saying jailing Wells would do no good to anyone.

McGinnis disagreed, citing the impact statements and facts of the case, with the boy's mother and supporters of the victims' family, and Wells family and church members present, McGinnis formally sentenced Wells to five years on each count to be served concurrently.

If Wells' offense had been a single incident; if she had ceased contact with the victim after a confrontation by the boy's family; if she had not been a teacher, the offense may have warranted probation, McGinnis said.

"I have to treat this the same as I would a male teacher and a female student," McGinnis said. "I am not sure anyone benefits from jail."

Citing the reduced charge from the original charges in the guilty plea and concessions already made by the commonwealth, the judge said there would be no probation at the time being. Wells is also shielded from prosecution from possible criminal charges in Nicholas County involving the same victim.

"A significant break has already been cut with the plea," McGinnis said. "Probation is denied ... you are in custody."

The victim's supporters left shortly after the sentence was announced.


Wells' family members, visibly upset were consoled by others nearby as she was placed in a seat near another prisoner.

Wells was later taken to Mason County Detention Center for processing before a state facility is assigned, officials said.

" i do think its time to go after the administration of deming. They all knew way back when it first started when she went over the line as a teacher. Her co-workers, students, and parents seen but nothing way done by prinpical. We was all check seeing things. They all put our students in danger!!!!!!! It was all handle wrong. "

" Thank you Bob for your concern. I am a friend of Crystal Wells. And let me tell you all something! We the family and friends are devastated. No one can prepare you for this type of situation. The children are SAD and miss thier mommy. She is a wonderful mother to her children regardless of what anyone says. Sometimes "we" do things, and that "we" includes all of you that are self righteous enough to act like your perfect that we regret. If you think you do not make mistakes you better think again. We all do, some worse than others. Those people that judge Crystal for her actions will be the ones that someday pay. What comes around goes around. Those of you that condem her and talk about her and speak and think evil thoughts of her better watch out. Jesus stood by those who hurt him and those who did wrong. Those of you who think you are to good are no better than the devil himself. I bet the majority of you go to chruch on a regular basis, you call yourselves Christians? Are you behaving like Jesus did? I don't think so,You better take a long look at your life and your behavior. Crystal Wells is my friend and I will always be her friend. Those of you who think you know it all and beleive she is trash because of what she did better hold on. You never know what life will bring your way. What your friends and family will bring your way. " It's not possible to make a judgement on this situation without first knowing the circumstances surrounding the actual facts.

The judge has passed sentence, it's hoped his decision was one based on the above, rather than one based on what he thought the community wanted.

I'm always horrified by some of the nasty and hateful comments I read, but then, I'm willing to admit I'm not perfect, which allows me to empathise with anyone unfortunate enough to have their life ruined by their poor choices.

At 33, and a teacher, it's fair to assume she would have been more aware than most of the decision she was making, and it's consequences, but that's still no reason to kick her whilst she's down.

Just be thankful you're not her, be grateful for the fact you've never had to experience her circumstances, whatever they were, because maybe, just maybe, it could have been you who was now going to prison.

My sympathies to her family, they're not guilty of anything, yet I can imagine how they'll be punished by the weak and unforgiving who seem to get their enjoyment from others sadness. "

" It is a very sad situation for all involved, but she did something wrong, and should be punished. Her kids, I do feel sorry for. They will suffer with out their mom, but maybe she will learn. "

" I agree with the judge whole-heartedly. I hate the attitude that when it's a male teacher it's rape, but when it's a female teacher it's an inappropriate relationship. It's rape regardless of gender. It doesn't matter whether or not the child bragged about the relationship or whether or not he told her to leave him alone. If the victim was a girl I doubt that question would have even been raised. When an adult has sex with a child it is rape, and worse, because the offense is against a child. When that adult is a teacher, in a position of authority over that child, the crime is much worse. "

" It is ironic that minority groups of people sought equality at all costs in America, and now that it is time to meter equality in all areas of life in America, they plead for special consideration. Does jail make a difference? I believe it does for those that are a danger to themselves and society. Jail won't deter Ms. Wells. Ms. Wells must deter Ms. Wells. The school districts must act as advocates for the children and commit all their fuciciary responsibilities in protecting those children until they are 18 or older. The educators and teachers have union to advocate for them. Ms. Wells violated the public trust. Is she any more or less dangerous than a male that violates the public trust. You cannot use gender, religion, race, or sexual preference as your guide. You must use the facts and the laws of the land to determine severity of punishment for wrongdoing. "

" Its about time that a judge acknowledged the disparity in sentencing of men committing the same offense as women and the women getting lighter sentences. I hope she serves everyday of her sentence. There are men sitting in prison for longer terms for the same offense. Good on you judge. "
