Former Adams County Jail employee arrested Friday, July 25, 2008 2:06 AM EDT
After indictments were filed July 17, Dylan J. Carter, 21, pleaded not guilty July 18 to charges of sexual battery, dereliction of duty and theft in office stemming from his employment by the Adams County Sheriff's Office as a jailer in 2006. Carter was employed as a part-time civilian corrections officer at the facility from Aug. 15, 2005, to Dec. 22, 2006, police said. The complaint was brought to the attention of the sheriff's office and taken to the prosecutor's office in 2007. "Due to possible conflicts between agencies, an investigation concerning law enforcement has to go to the Ohio Bureau of Criminal Investigations, special investigation unit," said David Kelley, Adams County prosecuting attorney, in 2007. "The attorney general's office will be prosecuting the case." "BCI was brought in by Kelley, in February 2007," confirmed Chris Wagoner of the Ohio Attorney General's Office on Thursday. Wagoner is handling the prosecution of the case. According to Wagoner, referring to the indictment, the alleged crimes occurred July 27 through Nov. 10, 2006. The indictments include two counts of felony sexual battery, for alleged sexual conduct with an unidentified 25-year-old female inmate. The inmate is identified as "Jane Doe." "A prisoner, in simplified terms, does not have the ability to provide consent," Wagoner said."You cannot have consensual sex in jail."
