Cell tower construction approved by commission

Construction of new cell phone towers was approved recently by the Mason County Joint Planning Commission for three areas of Mason County.

According to Zoning Administrator Matt Wallingford, members of the planning commission granted approval to American Cellular or Cellular One, to construct 195-foot cell towers on Kentucky 435 in western Mason County; Pickett Lane in northwest Mason County; and Kentucky 11 at Kentucky 419 in eastern Mason County.

Wallingford said American Cellular's application is in accordance with a city of Maysville ordinance and state requirements in providing a report on whether or not the company could co-locate on existing cell towers in those areas, before constructing new towers.

"There were no other facilities in the areas they could co-locate on," Wallingford said.

During the commission's regular meeting on Aug. 6, concerned residents from the Kentucky 435 and Lewisburg area expressed their objections to the towers. Wallingford said concerns stemmed from one couple who plan to construct a new home on land adjacent to the tower and the view will now include a cell tower; the other land owner expressed concerns on how placement of the tower would impact his property if he decided to sub-divide his acreage for future development.

Wallingford said approval by commission members was "not in conflict with our comprehensive plan," which permits erection of cell towers on land zoned agricultural or industrial use.


"It's up to the landowner to say where placement of the tower will be and the company must abide by it," Wallingford said.

The company has leased the site at 3150 Pickett Lane from MARCWY, LLC; the site on Kentucky 435 between Kentucky 9 and Kentucky 10 from Donald Stapleton and others; and the site in Lewisburg at Kentucky 11 and Kentucky 419 from Paul Jackson and others.

The initial lease is for five years, with an automatic renewal of 10 terms of five years each.

Wallingford said the commission has required Cellular One to allow three more antenna on the tower for co-location purposes, should other cell phone providers wish to locate in the area.

American Cellular has also agreed to allow emergency service antenna to be located on each tower for use by local law enforcement, fire departments and emergency management needs at no charge to the agencies or local government.

" The person on 435 who is planning to have a tower on his land is all for the money noone else up or down the road were even asked who made the decision on where the towere are put "

" Residents are never asked or even told in advanace about construction of cell phone towers, because no one involved wants to answer the questions that follow. Questions such as: What health hazards are associated with living near cell phone towers? The federal government has not taken a stance on this issue, but there is some research suggesting higher occurences of lukemia among residents living near cell phone towers. This is why no one is informed in advance. Sometimes property owners are notified, because they are paid large sums of money to allow the cell company access to their land. But many times those land owners are so money hungry that they won't tell neighbors what is happening until one day the tower just appears. "
