Bracken debates Sunday alcohol sales

BROOKSVILLE -- With Judge-Executive Gary Riggs as moderator, those attending Bracken Fiscal Court Wednesday got a true taste of more than an hour of an impromptu town hall debate on the idea of extended hours and Sunday alcohol sales in the county.

At a previous meeting, magistrates were split on bringing a request of bar owner Frank Baker for extended hours and Sunday alcohol sales, to a meeting where the public could have more say on the issue.

Riggs broke the tie vote last month by agreeing to put the issue before the public. He explained to those absent from the last meeting that his vote was not an endorsement of the concept but a way to give everyone an opportunity to speak on the issue.

Baker attended the Wednesday meeting, as did nearly 40 representatives of communities and churches throughout the county.

First to speak against the proposal was Sheila Figgins, who emphasized her belief the county could not afford to provide countywide police coverage if bars were all permitted the requested options of being open until 1 a.m. weekdays and 1- 10:30 p.m. on Sundays.

"This is not good for the county," she said.


Letters of concern and even a three-page petition denouncing the need for extended alcohol sales hours or Sunday sales were presented to magistrates in Bracken County Fiscal Court, Wednesday. -- Wendy Mitchell/Staff
Baker countered with claims there have never been complaints filed against his establishment by police or the Alcohol and Beverage Commission, and that what patrons do once they leave his establishment is not his responsibility. Baker operates Rooster's on Neave-Milford Road.

"There have maybe been 11 DUI arrests in 10 years attributed to Rooster's patrons," he said.

He also stressed underage drinkers are not knowingly allowed to drink at his bar.

"We check ID at the door and if the ABC wants to check, they are welcomed to," Baker said.

A nearby resident of Rooster's complained of heavy traffic and damage attributed to Baker's patrons.

"From the moment you let out (close) the traffic is constant and we get no sleep. On Sunday, we don't have to worry about it," said Heather Brumley. "Our mail box has been knocked down and now I have a 16 year old learning to drive. Even if they drive responsibly, they are dealing with adults (who are drinking and driving) who don't get it."


Directing comments to the court, Brumley also asked why the court would even consider allowing more alcohol sales time while also lowering speed limits as a safety issue.

Baker tried to counter each comment from those in opposition to his request, but Riggs asked everyone making comments to address them to the court and try to limit the length.

Several church leaders addressed the court, stressing opposition to any alcohol sales, but acknowledging that option is not a realistic issue.

"I cannot see the benefit in this to anyone except for a profit for a few people," said Bob Cannon, pastor of Powersville Christian Church. "I see the effects of alcohol abuse. I would like to see anyone explain how this is truly a benefit for the county."

He also tempered opposition with a reminder of what may happen if churchgoers vent their displeasure politically.

"We are a voice to be heard at the polls," he said.

Magistrate Tim Figgins also presented a petition and letters he had received against the idea. Several other magistrates acknowledged they had also received calls and comments, and all were against it.

"I did not get one call in favor of the proposal," said Clark Hennessey.

Riggs acknowledged he had also received calls against the proposal and threats to his success in any future political campaigns.

After several comments against the issue, Figgins made a motion to kill the proposal, which would eliminate it from future old business unless another proposal is made; Perry Poe seconded the motion.

Though Magistrate Carl Allen abstained from the vote, his vote was counted as a yes with the majority, and the balance of magistrates voted to kill the request.

"It's over," Riggs said as Baker stood and left the meeting.

What good comes from alchol sales on Sunday except to deepen the pockets of a few. Why do most of us live in Bracken Co. I believe it's due to our laid back way of life and anything that is capable of changing that should be brought before the voters instead of left in the hands of the magistrates anyway. They are to serve the needs of the people, so why can't they at least poll us on things like this before making their vote. I would freely fill out a questionaire left in my mailbox from my magistrate instead of having him make a decision for me based on his lifestyle instead. "

" 1) I worship God everyday and do a lot of praying 2) I have kids begging me to help them to get off alcohol and drugs.3) I lost a baby to an alcoholic abuser 4) Christians deserve to have one day to worship with there families. This country was based on God , and when you to turn your backs on that you get just what you have right now .I would love to have the money the people who drink throw away to put in Gods house to get KIDS who are so badly hooked on the crap off of it . I would also love to have one minute with my child who died at the hand of a abusive drunk . That child would be 18 years old right now. Alcohol is destroying peoples lives and i pray that those of you who go out and get drunk and go to church , no what you are doing. I am a Christian not just one on Sunday !!! Why cant people set examples for the children of this community? When you are holding up a bar stool and then going to church on Sunday ,you are setting a really good one. THAT ALCOHOL COMES FIRST THEN GOD !!!! God so loved the world he gave his son to die for us and you repay him how by wanting to get drunk on Sunday. Also for all of you who think that religion should have no say in this of course it should its the Lords day not yours to get drunk. "

Pretty sad that a few people who go to the meetings have to use religion to make them feel more powerful. You should worship God everyday, not just on Sunday!! " I too am a Christian, but I still go to Rooster's on the weekends to mingle with friends and have a good time. But I am either a designated driver or have one. I am a member of a church in Foster KY and noticed that one of our members wrote a letter in the paper fighting against the proposal Frank had made, but this member failed to state that he too parties at Roosters with his family and never had a designated driver. No one is knocking anyone for going to church and having a day to serve the lord, just tired of those complaining that do just what they are complaining about. Again, as stated previously they will drink no matter where they get it. So let's support those that are our neighbors and support our county. "

There are other voters ya know, he can't make it happen/or not happen by hisself! The way I see it, Riggs did a great thing bringing it before the public and letting them have a say in it yet no one is appreiciative of that. One thing that I don't understand though is that Augusta is apart of Bracken County. Augusta is aloud to sell beer on Sunday yet nowhere else in Bracken Co. is...how fair is that?? It's one county, shouldn't everyone have the same rights? "

I won't be riding around out in the county running people off the road. I will be at home enjoying a day of football, NASCAR, baseball, or whatever else may happen that day. So please, don't throw your religion up in my face. I, too, believe in God. It's my choice and not your holier than thou preaching that will make my decisions for me. I still think that if the establishments wish to sell alcohol on Sunday, that should be their choice. " I grew up in the Brooksville area and moved to NC about 5 years ago. When I return to BC to visit it is as if I never left. The town has not changed in the least. It feels like Brooksville and Bracken County (with the acception of Augusta) is stuck in 1983. There is no leadership or people looking out for the best interest of the tax payers. No new development and the worst thing is no open minds. Bracken County will never reach its full potential until proper leadership is elected and its resident's get away from the "good ole boy"..."Ive known him all my life" types. Mr. Riggs seems to be cruising until it is time to retire. Perhaps the next judge exectuive should hail from Augusta. Augusta is vibrant and welcoming to outsiders and tourists a like. Added alcohol sales on Sunday's may or may not help the economic situation but the tax payers should be the ones to decide. Why aren't people as outspoken about the lack of jobs in area? I think Bracken County needs to realize that it is not moving in the right direction and some REAL leadership is needed. "

If you are going to be drinking you need to be responsible and find a designated driver. For these people placing articles in the papers complaining they go to roosters too. And from what I have seen they usually do not do the responsible thing and have designated drivers so they need to get off their soap box and be quiet. As you said these people know who they are and when these people are seen out there they should be reminded of this. Roosters is a nice establishment and they offer breakfast after the bar closes so that people can sit for a while and sober up a bit. But it is still YOUR responsibility to not drink and drive. We have people out here who have been caught drinking and driving more than 5 times, yet somehow they still end up getting their license back. I think we should work on getting a law passed where it's 3 strikes and your out!! Get a 3rd DUI and lose them for good.
