GEORGETOWN, Ohio | Two men were indicted by a Brown County grand jury, for activities related to the June death of James Mootispaw.
Theft and trafficking marijuana allegedly lead to his death.
Joseph Nicholas Trzeciak, 24, of Naples, Fla., was indicted for the murder of Mootispaw, 27, on June 7.
Darrell Mootispaw, 33, of Mount Orab, was also indicted in the shooting of his brother, James Mootispaw , on two counts of involuntary manslaughter, one count of trafficking in marijuana and one count of complicity in the commission of an offense.
According to the indictment, Darrell Mootispaw "did aid or abet James Mootispaw in the theft of $1,200 from Joseph Trzeciak by deception."
According to Mount Orab Police Department, it received a report of a disturbance at Hyde Park Apartments on June 7 and found James Mootispaw laying in front of the apartment complex.
Trzeciak allegedly fled the scene in a 2001 black Mazda pickup truck with Wisconsin plates.
Following up on information from a police “Be On the Look Out” alert, Trzeciak was arrested June 9 in White Cloud, Mich.
On Aug. 7, Trzeciak was indicted on one count of murder with a firearm specification.
According to the indictment, the death of James Mootispaw, "… was the proximate result of Darrell Mootispaw committing or attempting to commit the felony offense of trafficking in marijuana."
Trzeciak is being held in Brown County Detention Center on $500,000 bond.
No bond is set for Mootispaw who is also in BCDC.
Both will be scheduled to appear in Brown County Court of Common Pleas
